This web site is operated by Whiterose Equestrian Ltd. Your use of the site is subject to these terms of use, which you accept by using the site. These terms of use may be updated by us from time to time and without notice to you. The current version is always available on the site.
Parts of the site are accessible to all users and other parts of the site are restricted to users who have registered with us. These terms of use apply to all users, including registered users & visitors alike. We may, at our sole discretion, decline to register anyone as a registered user without giving any reasons.
The information contained on this web site may be changed or updated at any time without notice.
2 Contract Terms For Supply Of Goods
A contract between you and Whiterose Equestrian Ltd will exist when you place an order for goods.
Whiterose Equestrian Ltd will use its best endeavours to fulfil the order in a timely and efficient manner, but reserves the right to refuse or cancel the order at any time. If we cancel an order, we will only charge those costs we have incurred to the date of cancellation and we will notify you as soon as possible.
In the unlikely event of a product being incorrectly priced (ie we have made a mistake with the pricing) and you are overcharged, we will refund the difference if the price is lower. If the correct price is higher, we will request your re-acceptance of the order or cancellation instructions.
All delivery dates are estimates and are subject to availability.
Ownership of the goods remains vested in WhiteRose Equestrian Ltd until full payment has been received.
All items sourced specifically at the customers instruction and not being a stock item or are tailored to the customers specification are non-returnable.
3 Liability
The information contained on this web site is provided in good faith, and every reasonable effort is made to ensure that it is accurate and up to date. Accordingly, this information is provided 'as is' without warranty of any kind. WhiteRose Equestrian Ltd excludes all warranties, either express or implied (including, but not limited to any implied warranties of merchantability, fitness for a particular purpose, satisfactory quality or freedom from hidden defects).
WhiteRose Equestrian Ltd shall not be liable for any damage or injury arising, directly or indirectly, from the use of the information contained on this web site including damages arising from inaccuracies, omissions or errors and/or from the use of the products or services purchased by the buyer.
WhiteRose Equestrian Ltd shall not be held liable for consequential damages including loss of revenue, loss of profit, loss of opportunity or other loss.
For the avoidance of doubt nothing contained in these conditions excludes the responsibility WhiteRose Equestrian may have for death or personal injury caused to the customer or other third parties, caused by the negligence of WhiteRose Equestrian Ltd, its employees, products or services.
Although we shall take reasonable steps to prevent the introduction of viruses, we do not warrant that any information or other content accessible via our site is free from viruses, or other harmful matter, nor that our site will be error free.
4 Guarantees
If on receipt, you find the goods unsuitable or you are not totally satisfied, providing you notify us in writing within 7 working days from receipt of the goods and return them to us unsoiled, unused and in the original packaging you will be entitled to an exchange or refund (less any external charges incurred, packaging and postage). It is your responsibility to arrange and pay for the return. The goods should be well packed and clearly labelled. Proof of postage should be obtained, as should a returned parcel become damaged or lost, we do not compensate.
Goods damaged through defective material or poor workmanship should be returned for our urgent attention. Please contact us by phone - 44 (0)1625 860557 and confirm in writing by email, fax 44 (0)870 7052095 or letter. The item may have to be returned to the manufacturer for testing, so please allow 28 days for this process. Under no circumstances should items be continued to be used when defective or damaged. If you do you will be deemed to have accepted the goods in their defective or damaged condition. It is your responsibility to arrange and pay for the return. The goods should be well packed and clearly labelled. Proof of postage should be obtained, as should a returned parcel become damaged or lost, we do not compensate. Postage fees will be reimbursed for justified claims.
We are unable to give refunds on items not notified to us within 7 days (and subject to notification above), or damaged goods not notified to us within 7 days from receipt.
5 Intellectual Property
The site is proprietary and you may not copy anything on it.
All copyright and other rights (including, without limitation, intellectual property rights) in and to the site and the material on the site are owned by us or by others. You may not use, copy, adapt, modify, sell, license, distribute, transmit, display, publish or create works derived from the site or the content or any part thereof.
"Whiterose Equestrian Ltd" is our trade mark and there are other trade marks, names and logos on the site which belong to us or other people. You do not have any licence or right to use any of them.
6 User Obligations - The Information You Provide
In consideration of your use of the site, you agree (a) to provide true, accurate, current and complete information about yourself when prompted by our registration form or any other form we ask you to complete at any time and (b) to maintain and update promptly any personal information which you are able to update on the site so as to keep it true, accurate, current and complete. You will not defame or infringe the rights of others.
7 User Obligations - Your Username And Password
No person other than you is authorised to use your username or password. You must keep your username and password confidential and take all reasonable precautions to prevent unauthorised use thereof. If you suspect that anyone else has used or is using your username and password, you must notify us immediately. You are responsible for all use of the site with your username and password whether or not the use was actually yours.
8 User Obligations - Minimum Age For Legal Use
It is our policy that visitors to our site who are under the age of 18 should not purchase goods or services or provide information without the consent of their parents or legal guardians. You should supervise the online activities of your children, and consider the use of parental control tools available from online services and software providers that help provide a child-friendly Internet environment.
9 Termination
We may terminate or suspend the registration or permissions of any registered user, at will and without notice, in whole or in part at any time. Such termination or suspension shall not give rise to any liability of Whiterose Equestrian Ltd.
10 Jurisdiction
These terms of use and any claim relating to the use of the site, the content, our products and services are governed by English law and you consent to the exclusive jurisdiction of the courts of England and Wales in relation to any dispute arising in connection therewith.
11 Descriptions
Every care has been taken to ensure descriptions, measurements, colours and prices etc are correct, but we reserve the right to make changes as required and without notification.
12 Goods Sent Outside UK
Goods ordered from WhiteRose Equestrian Ltd for delivery outside the UK may be subject to import duties and taxes. Any charges must be paid by you.
13 Distance Selling Regulations
